A will contest is a formal objection to a will’s validity. Wills are often challenged over undue influence, fraud, or lack of testamentary capacity. If a will contest is successful, the will will not be enforced.

Inheritance theft is when someone steals money, personal property, or real estate that was intended to be passed down to an heir or beneficiary of an estate. Sometimes, the theft is simple: the person simply took the property. Other times, it’s more complicated, like when a bad actor changes the terms of a will or alters documents to transfer property they weren’t supposed to get.

Wrongful Death” is a death caused by a wrongful act, neglect, or failure to act that would have been a personal injury suit if the person had lived. Typically, a claim for wrongful death is filed on behalf of the dead person by a representative of the dead person’s estate.

Probate can be daunting even when relatives are not fighting.
